Parties
These terms are offered by Globalstrand S.R.L., registered in the Republic of Moldova, str. Uzinelor 19, MD-2023 Chișinău, phone +373 22 47 06 18, email [email protected] ("we", "the studio"). "Client" means the person or company that accepts our estimate or books a hall.
Use of this website
The website at globalstrandauas.cc is information about the studio. It does not sell anything online and no contract is concluded through it. Photographs and texts on the site belong to the studio or are used with the permission of our clients and may not be reused without written consent.
We try to keep rates, sizes and dates on the site accurate, but the figures in a written estimate are the ones that apply to your job.
Estimates and booking
After a brief, we send a written estimate listing the work, the people, the rooms, the equipment and the delivery dates. An estimate is valid for fourteen days. A job is confirmed when the client accepts the estimate in writing, by email is enough, and pays the first instalment.
Dates in the calendar are held as a light pencil for three working days after the estimate is sent. If another client asks for the same date in that time, we will call you before releasing it.
Changes to the scope after confirmation are agreed in writing with a revised estimate before the extra work is done.
Prices and payment
Prices are in Moldovan lei and exclude value added tax, which is added at the rate in force on the invoice date, currently 20%. Clients outside Moldova may be invoiced in euro at the official exchange rate of the National Bank of Moldova on the invoice date.
Unless the estimate says otherwise, we invoice 50% on confirmation and 50% on delivery, payable within fourteen days. Third-party costs such as location fees, permits, talent and travel may be invoiced in advance at cost. Late payments carry interest as provided by the Civil Code of the Republic of Moldova.
Cancellation and weather
- Cancelled more than ten working days before the shoot: we keep the cost of planning work already done and any non-refundable third-party costs.
- Cancelled between ten and three working days before: 50% of the studio and crew fees, plus third-party costs.
- Cancelled less than three working days before: the full studio and crew fees, plus third-party costs.
For location days, every call sheet includes a weather plan. If we decide together that weather makes the day impossible, we move it to the next available date without a cancellation charge; crew who were already booked may be paid a half-day fee as set out in the estimate.
Hire of the halls
Halls are hired by the hour with a four-hour minimum, or by the day of ten hours including setup and strike. Time starts at the booked hour, not on arrival. The hall is returned in the state it was received; repainting of the cyclorama after marks or coloured light gels left on the wall is charged at cost.
Smoke, haze, open flame, live animals and food preparation on set need to be agreed in advance. Smoking is not permitted anywhere in the building. The hirer is responsible for their own crew and guests while in the building and must follow the safety instructions of the studio manager.
Equipment
Equipment from the studio is checked out and back in against the log with the studio manager. The hirer is responsible for loss or damage from check-out to return, other than normal wear. Equipment taken off the premises requires proof of insurance.
Delivery and approval
Delivery dates in the estimate run from the last shoot day. Stills selects are delivered within 48 hours, retouched stills within seven working days, an offline film cut within five working days and a graded master within ten, unless the estimate says otherwise. Two rounds of changes are included; further rounds are charged at the hourly rate.
Delivered work is considered accepted if the client has not raised a specific objection in writing within ten working days of delivery.
Copyright and use
Copyright in photographs and films created by the studio arises under Law No. 139 of 2 July 2010 on copyright and related rights. Unless the contract provides otherwise, on full payment the client receives a licence to use the delivered material for the purposes, territories and period stated in the estimate. Wider use is agreed and priced separately.
Releases from people on camera and location agreements are obtained by the studio for the use stated in the estimate. Use beyond that scope may require new releases, which the client is responsible for unless we agree to obtain them.
We may show finished work in our portfolio and on this site after the client's own publication, unless the client asks us in writing not to.
Liability and insurance
The studio carries public liability insurance for its premises and its own crew. Our liability to a client for any job is limited to the fees paid for that job, except for damage caused intentionally or by gross negligence, and for harm to life or health, where the limits of the Civil Code apply.
We are not liable for delays caused by events beyond our reasonable control, such as decisions of public authorities, power outages in the district or severe weather, but we will tell you as soon as we know and propose a new date.
Consumers
Most of our clients are businesses. If you are a private individual commissioning work for personal use, you also have the rights given to consumers by Law No. 105 of 13 March 2003 on consumer protection, and nothing in these terms limits them.
Law and disputes
These terms and every contract with the studio are governed by the law of the Republic of Moldova, in particular the Civil Code of the Republic of Moldova. We will try to settle any disagreement by talking first. If that fails, disputes are decided by the competent courts in Chișinău, unless mandatory rules for consumers say otherwise.
Questions about these terms can be sent to [email protected] or by post to str. Uzinelor 19, MD-2023 Chișinău.
